Validation in Spain of the rights conferred by a european patent application


A European Patent containing the designation of Spain shall only become effective in our country if a translation of the description and the claims into Spanish is filed with the Spanish Patent Office within three months of the publication of the mention of the grant. The translation must be made by a Spanish Patent Attorney or by a Spanish sworn translator.

In order to proceed to the validation of a European Patent we only need the description and claims as granted, a copy of the drawings, if any, the front page of the B1 document leaflet and a power of attorney. The front page of the B1 and the power of attorney may be filed later. In order to observe the time limit it is sufficient to file the translation.

The provisional protection conferred by a European Patent Application after publication shall not be effective in Spain until such time as a translation of the claims into Spanish has been made available to the public in the Spanish Patent Office. This happens one month after filing of the translation.

In order to proceed to the validation in Spain of the provisional rights conferred by a European Patent Application we need the text of the claims as published, a copy of the drawings, if any, and a power of attorney. The power of attorney may be filed later.
